6/27/11 Commissioners Special Meeting Minutes:
The Board of Bear Lake County Commissioners
met in a special meeting on June 27, 2011, beginning at 9:00 A.M.
in the School District #33 Board Room in Paris, Idaho. Members
presented were Vaughn N. Rasmussen, Chairman, Montain D. Kunz,
DeMar Romrell and Kerry Haddock, Clerk of the Board.
Lynn Lewis, Assessor and Lori Haddock, Appraiser, also attended
the meeting.
BOARD OF EQUALIZATION
Commissioner Romrell made a motion seconded by Commissioner Kunz
to convene as a Board of Equalization per Idaho Code 63-501.
Motion carried. The Commissioners reviewed valuation appeals
and discussed each with the Assessor and Appraiser. Final decisions
will be made in the July 11, 2011 Commissioners meeting. Commissioner
Kunz made a motion seconded by Commissioner Romrell to reconvene
in special session. Motion carried.
EXECUTIVE SESSION
Commissioner Romrell made a motion seconded by Commissioner Kunz
to convene in an executive session per Idaho Code 67-2345(d) to
discuss an indigent case. All Commissioners voted yes in a roll
call vote.
MEDICAL ASSISTANCE CLAIM
Following the executive session Commissioner Kunz made a motion
seconded by Commissioner Romrell to deny Case 2011-10 - Not the
last resource, Medicaid approved.

THE BOARD OF BEAR LAKE COUNTY COMMISSIONERS WILL MEET AS A BOARD OF EUQALIZATION PER IDAHO CODE 63-501 TO HEAR APPEALS OF ASSESSMENTS ON MONDAY, JUNE 27, 2011 AT 9:00 A.M. IN THE SCHOOL DISTRICT #33 BOARD ROOM, PARIS, IDAHO.
AFTER THE BOARD OF EQUALIZATION MEETING, THE COMMISSIONERS WILL MEET IN EXECUTIVE SESSION TO DISCUSS MEDICALLY INDIGENT CLAIMS PER IDAHO CODE67-2345(d).
6/23/11 Public Meeting Minutes:
The Board of Bear Lake County Commissioners met in a special session on Thursday, June 23, 2011, beginning at 5:00 P.M. at the intersection of Highway 89 and a new road in the Toliver Subdivision. Members present were Vaughn N. Rasmussen, Montain D. Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board.
TOLIVER SUBDIVISION INSPECTION
Mitch Poulsen, Christensen, Toliver, and Smith met with the Commissioners
to jointly inspect a new road and the associated drainage in the
subdivision. The owners asked the County to take ownership of
the road. The road appeared to be well built. The main point
of disagreement was ownership and maintenance of several catch
basins that were part of the drainage system. The Commissioners
will check past minutes regarding the subdivision prior to making
a decision.
The Commissioners moved to the School District #33 Board Room in Paris, Idaho to continue the meeting.
ST. CHARLES AND FISH HAVEN PROJECT
Officials of The Idaho Department of Transportation and Horrocks
Engineering met with the Commissioners to outline projects adding
turn lanes on Highway 89 for St. Charles Canyon and North Beach
Road, and Fish Haven Canyon. Idaho Department of Transportation
people attending were Chris Piersal, Mark Snyder, Charlie Dietz
and Cory Tranz. Horrocks Engineering people attending were Jim
Young, Dan Jones and consultant Sandy Williams. The projects will
be done in 2012 and 2013. Charlie Dietz explained the process
that was used to identify and prioritize the projects. All the
projects were to reduce turning conflicts and promote safety.
Following the presentation the Commissioners asked several questions.
Members of the public were then allowed to ask questions and
make comments. A number of Fish Haven residents were concerned
with increased congestion that they felt would occur due to the
project.
SUNDAY LIQUOR BY THE DRINK ORDINANCE #2011-04
Tony Crowson of Coopers, Louis Pope of Clover Creek Inn and Don
Johnson representing the VFW met with the Commissioners regarding
passing an ordinance allowing liquor by the drink on Sunday.
Following a short discussion, Commissioner Kunz made a motion
seconded by Commissioner Romrell to adopt Ordinance #2011-4, allowing
liquor by the drink on Memorial Day and Sundays. Motion carried.
ORDINANCE 2011-04
AN ORDINANCE PERMITTING THE SALE OF LIQUOR BY THE DRINK ON SUNDAYS AND MEMORIAL DAY; AND EXTENDING THE HOURS OF THE SALE OF LIQUOR BY THE DRINK ON FRIDAYS AND SATURDAYS UNTIL 2:00 O'CLOCK A.M.
WHEREAS, THE Board of County Commissioners of Bear Lake County, Idaho deem it to be in the best interests of the County, to encourage tourism and for the benefit of local business within Bear Lake County, Idaho, and pursuant to Idaho code 23-927(2).
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF BEAR LAKE COUNTY, IDAHO AS FOLLOWS:
Section 1: Liquor by the drink may be sold, offered for sale, or given away upon any licensed premises, unless otherwise prohibited by law, during the following hours:
a) On any Sunday, not otherwise prohibited
by law, between the hours of 11:00 o'clock A.M. and 12:00 o'clock
Midnight.
b) On Memorial day, not otherwise prohibited by law.
c) On any Friday and Saturday, not otherwise prohibited by law,
between the hours of 10:00 o'clock A.M. and 2:00 o'clock
A.M. of the following day.
Section 2: Any person or entity who violates any provision of
this ordinance shall be guilty of a misdemeanor, and upon conviction
of the same shall be punished as set forth in Idaho Code Section
18-113, or if said code has been repealed, the maximum punishment
shall be confinement in Jail for a period not to exceed six (6)
months and/or a fine of One Thousand Dollars ($1000.00).
Section 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
Section 4: This ordinance shall be in full force and effect, after its passage, approval and publication according to law, from July 1, 2011.

6/13/11 Commissioners Meeting Minutes:
The Board of Bear Lake County Commissioners
met in regular session on Monday, June 13, 2011, beginning at
9:00 A.M. in the School District #33 Board Room in Paris, Idaho.
Members present were Vaughn N. Rasmussen, Chairman, Montain
D. Kunz, DeMar Romrell and Kerry Haddock, Clerk of the Board.
Brent Bunn, Sheriff, Lynn Lewis, Assessor, Tricia Poulsen, Treasurer,
Greg Skinner, Road Supervisor, Bill Stock and Valerie Hayes also
attended the meeting.
AGENDA APPROVED
Items added to the agenda were the Dingle culvert project and
a Juvenile Justice agreement. Commissioner Kunz made a motion
seconded by Commissioner Romrell to approve the agenda as amended.
Motion carried.
ELECTED OFFICIALS MEETING
Sheriff Bunn presented his monthly report. He noted that there
was lots of juvenile activity. He reported on the enhanced 911
system. The Sheriff had an inquiry regarding enforcement of the
Solid Waste Ordinance. This will be added to next month's agenda.
Clerk Haddock and the Sheriff noted that upgrades to the County's
computer system, including a new server, had been strongly recommended
by Computer Arts. The Commissioners gave their approval to proceed
with the project. Treasurer Tricia Poulsen presented a tax cancellation
on property which should have been exempt from taxation. Commissioner
Romrell made a motion seconded by Commissioner Kunz to approve
the tax cancellation. Motion carried. August 8 was set as a
tentative date to sell property that had been tax deeded to the
County.
SUNDAY LIQUOR SALES
Louis Pope, Tony Crowson and Don Johnson met with the Commissioners
and asked them to reconsider allowing Liquor by the drink on Sundays.
They presented information on surrounding Counties and the State
of Utah which allows Sunday sales. The Commissioners agreed to
consider an ordinance at their June 23rd meeting.
IDAHO FISH AND GAME PROPERTY BOUNDARY
Don Jenkins, Idaho Fish and Game, informed the Commissioners that
some of the land fill activities were encroaching on Fish and
Game property. He will have a surveyor mark the property line.
AMBULANCE AGREEMENT
The Commissioners signed an agreement with Access Idaho, which
will allow the Ambulance Service to receive payments by credit
card.
ZONING MAP
Mitch Poulsen presented and updated zoning map for the County
which was much more clearly defined. He would like to digitize
the map and put on the website.
MINUTES APPROVED
Commissioner Romrell made a motion seconded by Commissioner Kunz
to approve the minutes of the May 9, 2011, regular meeting. Motion
carried. Commissioner Kunz made a motion seconded by Commissioner
Romrell to approve the minutes of the May 23, 2011 special meeting.
Commissioners Kunz and Romrell voted yes and Commissioner Rasmussen
abstained as he wasn't at the meeting.
BILLS APPROVED
Commissioner Kunz made a motion seconded by Commissioner Romrell
to approve the current bills. Motion carried.
BEAR LAKE MONSTER BIKE RIDE
Jared Eborn discussed the upcoming Bear Lake Monster bike ride.
He had lowered his expectations for participants to about 250.
The event would start and end in Montpelier. Dennis Duehren
noted that the forest Service had permitted the portion on Minnetonka
Cave Road with certain restrictions. Cory Kranz, Idaho Department
of Transportation gave information on their permitting process.
The County will discuss an event permitting process at the next
meeting.
NATIONAL FLOOD INSURANCE
Wayne Davidson updated the Commissioners on the National Flood
Insurance program. The County had recently been accepted into
the emergency phase of the program. The next step will be to
get a flood plain map of the County. Steve Allred, Zion's bank,
thanked the Commissioners for participating in the project and
offered Zion's help with the flood plain map.
COURTHOUSE UPDATE
Wayne Davidson presented architect's plans for a Courthouse upgrade.
The plans would provide handicap accessibility to the Courtroom
and other County offices. The next step will be to seek grant
money with the help of SEICOG.
BLASTING AND CRUSHING BIDS
Bids were received for blasting and crushing at Montpelier Canyon
Dam as follows:

$4.05 per cubic yard

$22,000 per month

$25,000 per month
Commissioner Kunz made a motion seconded by Commissioner Romrell to accept the low bids of Custom Blasting and Kimball. Motion carried.
MEADOW ROW SUBDIVISION FINAL PLAT
Glade Hymas presented the final plat for Meadow Row Subdivision.
Commissioner Romrell made a motion seconded by Commissioner Kunz
to approve the final plat. Motion carried.
HIGHWAY 89 UPGRADE IN FISH HAVEN
Clark Stock and Bill Stock presented letters and signatures from
Fish Haven residents asking the Commissioners to support them
in opposing the proposed Highway upgrade in Fish Haven. The Idaho
Department of Transportation has proposed adding turn lanes at
Fish Haven Canyon to improve safety and traffic flow. The Commissioners
and Idaho Department of Transportation will hold an informational
meeting to discuss the project on June23rd. The Commissioners
will take no action prior to that meeting.
EXECUTIVE SESSION
Commissioner Romrell made a motion seconded by Commissioner Kunz
to convene in executive session per Idaho Code 67-2345(b, d, and
f) to discuss indigent claims, legal and personnel issues. Al
l Commissioners voted yes in a roll call vote.
PICTOMETRY
Brian Kiene, Pictometry, presented information for budgeting and
some upgrades wanted by the Assessor's office. He presented a
demonstration of a web based user feature that would make the
program easier to use. He also demonstrated an add-on program
that would identify any changes made between flyovers. He presented
details on a longer term contract that could save the County money.
SHORELINE CONFERENCE AND PATHWAYS UPDATE
Dave Cottle reported that the Shoreline Conference went well.
He also reported on progress of the Bear Lake Legacy Pathway.
KELLER ENGINEERING
The Commissioners considered a proposal from Keller Engineers
to provide engineering services for Road and Bridge and Planning
and Zoning. Commissioners Romrell made a motion seconded by Commissioner
Kunz to use Keller Engineering for these services on an as needed
basis. Motion carried.
PEGRAM RIGHT OF WAYS
Keith Rigby asked the Commissioners to vacate some unused right
of ways in the Pegram area. The Commissioners will need to advertise
for a future meeting and will vacate if no one objects.
ROAD AND BRIDGE ISSUES
Greg Skinner presented his monthly report. They were still doing
repair work on washed out roads. He presented information on
traffic counts on East Shore Road, Hot Springs Road and Loveland
Lane.
EXECUTIVE SESSION
Commissioner Romrell made a motion seconded by Commissioner Kunz
to convene in an executive session per Idaho Code 67-2345(b) to
discuss a personnel issue. All Commissioners voted yes in a roll
call vote.
Following the executive session Commissioner Romrell made a motion seconded by Commissioner Kunz to act on indigent claims as follows:
MEDICAL ASSISTANCE CLAIMS
Commissioners approved claims #2011-14 - medically indigent, obligated
County, last resource, medically necessary - approved for the
Pre-existing Condition Insurance Plan - County to pay monthly
premiums on a month by month basis; #2011-15 - medically indigent,
obligated County, last resource, emergency service - approved
for the Pre-existing Condition Insurance Plan pending Veteran's
Benefits - County to pay monthly premiums until Veteran's Benefits
are approved.
